This BtrQL compiler EULA (the "Agreement") is a legal agreement between Kostiantyn Voznesenskyi ("Licensor," "we," "us," or "our") and the individual or entity using the Software ("you" or "your").

By downloading, installing, copying, or using the Software, you agree to this Agreement. If you do not agree, do not download, install, copy, or use the Software.

1. Definitions

"Software" means the BtrQL Compiler, a local compiled application distributed by Licensor for processing BtrQL Input Files and generating Generated SQL Output. The Software includes any Java bytecode, object code, executable files, JAR files, class files, native images, launchers, installers, bundled runtime components, libraries, command-line tools, desktop applications, documentation, examples, sample files, updates, and related materials distributed by Licensor.

The Software is a compiler, transpiler, or related developer tool for processing source text written in Better Query Language ("BtrQL") and generating SQL output. Better Query Language is the source language and input format recognized by the Software. For purposes of this Agreement, Better Query Language itself, including its syntax, grammar, semantics, concepts, ideas, and principles, is not Software, source code, object code, or any other executable or distributable software component. This Agreement governs only the Software distributed by Licensor.

The Software does not include your BtrQL Input Files or Generated SQL Output.

"BtrQL Input Files" means files with the .btrql extension, and any Better Query Language source text, configuration, schema references, metadata, comments, identifiers, string literals, or other content that you create, provide to, import into, or process with the Software.

"Generated SQL Output" means SQL statements, scripts, files, queries, migrations, reports, or other SQL-formatted material generated by the Software from or in response to BtrQL Input Files, including files with the .sql extension.

"Third Party" means any individual or entity other than you, your employees, contractors, or other authorized users acting on your behalf for your internal use.

2. Free Local-Use License

Subject to this Agreement, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software free of charge for personal, internal, and business purposes.

The Software is provided as a local compiled application, including any Java bytecode, object code, executable files, JAR files, class files, native images, launchers, installers, bundled runtime components, libraries, and related documentation distributed by Licensor. The Software is not provided as source code unless Licensor expressly states otherwise.

The Software is not provided by Licensor as a cloud service, hosted service, managed service, API, software-as-a-service product, platform-as-a-service product, or remote processing service. Licensor does not operate the Software on your behalf.

This Agreement does not grant you any right to receive, access, use, modify, distribute, or sublicense the source code of the Software.

3. Hosted Access, API Access, and Service Restrictions

You may not provide the Software, or access to any substantial part of its functionality, to Third Parties as a hosted, managed, API-accessible, software-as-a-service, platform-as-a-service, service bureau, wrapper, gateway, proxy, bot, plugin-hosting service, or other remotely accessible offering without Licensor's prior written permission.

You may not use the Software to process, transform, compile, translate, analyze, generate, or return results for Third Parties as part of a public or private hosted service, whether offered for free, for payment, internally, commercially, or otherwise.

Internal use by you or your organization is permitted, provided that Third Parties do not receive direct or indirect access to the Software's functionality as a service.

This section does not prohibit you from running the Software on your own internal devices, servers, build systems, or CI/CD systems solely for your own internal use, provided that Third Parties do not receive access to the Software or to the Software's functionality as a hosted, managed, API-accessible, or service-based offering.

For clarity, this section does not prohibit you from using, running, deploying, publishing, distributing, sublicensing, commercializing, or delivering Generated SQL Output, provided that Third Parties do not receive access to the Software or to the Software's functionality as a hosted, managed, API-accessible, or service-based offering.

4. Additional Restrictions

Except as expressly permitted by this Agreement or by applicable law, you may not:

(a) copy, redistribute, sell, resell, rent, lease, lend, sublicense, or otherwise transfer the Software to any Third Party;

(b) modify, adapt, translate, merge, alter, or create derivative works of the Software;

(c) reverse engineer, decompile, disassemble, attempt to derive the source code of, or attempt to discover the underlying structure, ideas, algorithms, or implementation of the Software;

(d) remove, alter, or obscure any copyright, trademark, license, or proprietary notices in or associated with the Software;

(e) circumvent, disable, or interfere with any license, security, access-control, usage-limit, or technical-protection mechanism in the Software;

(f) use the Software in violation of applicable law or regulation; or

(g) use the Software in a way that infringes, misappropriates, or violates the rights of any person or entity.

You may make a reasonable number of copies of the Software solely for backup, archival, or internal deployment purposes, provided that all copies remain subject to this Agreement and include all original proprietary notices.

5. Ownership of the Software

The Software is licensed, not sold. Licensor and its licensors retain all rights, title, and interest in and to the Software, including all source code, object code, executable code, Java bytecode, parser, compiler, transpiler, query engine, algorithms, translation rules, user interface, design, documentation, trademarks, examples, sample files, and other Licensor intellectual property.

Except for the limited license expressly granted in this Agreement, Licensor reserves all rights in the Software. No rights are granted by implication, exhaustion, estoppel, or otherwise.

6. Ownership of BtrQL Input Files and Generated SQL Output

You retain all rights, title, and interest in your BtrQL Input Files. Licensor does not claim ownership of your BtrQL Input Files.

Licensor does not claim ownership of Generated SQL Output produced by the Software from your BtrQL Input Files. As between you and Licensor, you may use, copy, modify, run, deploy, publish, distribute, sublicense, and commercialize Generated SQL Output for any purpose, including in production databases, applications, services, and commercial products.

Licensor will not assert any copyright or other intellectual property claim against you in Generated SQL Output solely because it was generated by the Software.

Nothing in this section transfers ownership of the Software, source code, object code, executable code, Java bytecode, parser, compiler, transpiler, query engine, algorithms, translation rules, user interface, design, documentation, trademarks, examples, sample files, or other Licensor intellectual property.

You are responsible for your BtrQL Input Files and Generated SQL Output, including ensuring that you have the rights needed to provide BtrQL Input Files to the Software and to use, run, distribute, publish, commercialize, or deploy Generated SQL Output.

7. No Embedded Runtime or Third-Party Library Code in Generated SQL Output

The Software currently translates BtrQL Input Files supplied by you into Generated SQL Output. Generated SQL Output is intended to be derived from your BtrQL Input Files and the Software's translation rules.

The Software does not add, link, embed, or distribute a Licensor-owned runtime library, standard library, helper library, third-party software library, executable component, or separately reusable software component as part of Generated SQL Output.

The Software does not provide access to, fetch, include, compile, or reuse third-party BtrQL libraries, modules, packages, source files, or other BtrQL code unless you provide that code to the Software. You are solely responsible for obtaining all rights and permissions needed to use any third-party BtrQL code that you provide to the Software.

This Agreement does not grant you any rights to third-party BtrQL source code, libraries, modules, packages, schemas, database objects, or other third-party materials, even if Generated SQL Output reflects or derives from such materials supplied by you.

8. Local Processing and No Data Collection

The Software is designed to run locally on your device or infrastructure. Licensor does not receive, access, store, collect, transmit, or process your BtrQL Input Files, Generated SQL Output, project files, database schemas, credentials, queries, logs, or other user data through the Software.

Licensor does not collect telemetry, analytics, crash reports, usage data, or other user data through the Software unless you voluntarily provide such information to Licensor outside the Software, such as by sending files, logs, examples, screenshots, issue reports, support requests, emails, or other materials to Licensor.

If you voluntarily provide such materials to Licensor, you grant Licensor a limited, non-exclusive license to use them solely as necessary to respond to your request, provide support, investigate bugs, improve compatibility, maintain security, or comply with law. This license does not give Licensor ownership of your materials.

Unless you separately give explicit permission, Licensor will not use voluntarily provided BtrQL Input Files or Generated SQL Output to train machine learning models, build datasets, improve unrelated products, or create services for Third Parties.

9. User Responsibility for Inputs, Use, and Output

You are solely responsible for your use of the Software, including your BtrQL Input Files, configuration, naming choices, comments, identifiers, string literals, database schemas, metadata, third-party BtrQL code supplied by you, and any other materials or instructions provided to or processed by the Software.

Licensor is not responsible or liable for Generated SQL Output that contains, reflects, preserves, derives from, or is caused by your BtrQL Input Files, third-party BtrQL code supplied by you, or your use of the Software, including output that is unlawful, offensive, abusive, inappropriate, misleading, defamatory, discriminatory, infringing, harmful, or otherwise unwanted.

You are solely responsible for reviewing, testing, validating, editing, approving, and deciding whether to use, run, publish, distribute, commercialize, or deploy any Generated SQL Output.

10. No Support or Maintenance Obligation

Licensor has no obligation to provide support, maintenance, updates, patches, upgrades, bug fixes, compatibility updates, or new versions of the Software.

If Licensor provides updates, patches, upgrades, or new versions, they are part of the Software and are subject to this Agreement unless Licensor provides them under different terms.

11. Disclaimer of Warranties

The Software is provided free of charge and "as is," "as available," and with all faults. Licensor makes no warranties, representations, or guarantees of any kind, whether express, implied, statutory, or otherwise.

To the maximum extent permitted by applicable law, Licensor disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, security, compatibility, performance, and error-free or uninterrupted operation.

The Software may produce Generated SQL Output that is incorrect, incomplete, unsafe, destructive, incompatible with your database, unsuitable for your intended purpose, or otherwise unexpected.

You are solely responsible for reviewing, testing, validating, and backing up your BtrQL Input Files, Generated SQL Output, databases, systems, and data before using the Software or running any Generated SQL Output, especially in production environments.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Licensor will not be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or other damages arising out of or related to the Software, BtrQL Input Files, Generated SQL Output, or this Agreement, whether based on contract, tort, negligence, strict liability, warranty, statute, or any other legal theory.

This includes, without limitation, damages or losses arising from data loss, database corruption, deletion or modification of data, security incidents, business interruption, lost profits, lost revenue, lost savings, missed opportunities, loss of goodwill, reputational harm, procurement of substitute goods or services, system downtime, failed deployments, inaccurate results, harmful queries, unlawful Generated SQL Output, offensive or abusive Generated SQL Output, third-party BtrQL code supplied by you, or any other loss arising from your use of or inability to use the Software or Generated SQL Output.

The limitations and exclusions in this section apply even if Licensor has been advised of the possibility of such damages and even if any remedy fails of its essential purpose.

To the maximum extent permitted by applicable law, Licensor's total aggregate liability for all claims arising out of or related to the Software, Generated SQL Output, or this Agreement will not exceed the amount you paid to Licensor for the Software. Because the Software is provided free of charge, this amount is zero unless applicable law requires otherwise.

Nothing in this Agreement excludes or limits liability to the extent such liability cannot be excluded or limited under applicable law.

13. Termination

This Agreement is effective until terminated. Your rights under this Agreement automatically terminate if you breach any term of this Agreement.

Upon termination, you must stop using the Software and delete or destroy all copies of the Software in your possession or control. Termination does not affect your rights in BtrQL Input Files or Generated SQL Output that you lawfully created before termination.

Sections concerning restrictions, ownership, generated output, local processing and voluntarily provided materials, user responsibility, disclaimers, limitation of liability, termination, governing law, venue, dispute resolution, and miscellaneous terms survive termination.

14. Governing Law; Venue; Dispute Resolution

This Agreement and any dispute arising out of or relating to the Software, BtrQL Input Files, Generated SQL Output, or this Agreement will be governed by the laws of Poland, excluding its conflict-of-law rules.

Subject to any mandatory rights you may have under applicable consumer protection laws, the competent courts in Warsaw, Poland will have exclusive jurisdiction over any dispute arising out of or relating to the Software, BtrQL Input Files, Generated SQL Output, or this Agreement.

Before bringing a claim in court, the parties will first attempt to resolve the dispute informally by written notice and good-faith discussions. If both parties agree after a dispute arises, the parties may attempt to resolve the dispute through mediation.

Nothing in this Agreement prevents either party from seeking urgent injunctive, protective, or interim relief from a court of competent jurisdiction.

Nothing in this section limits any rights that cannot be excluded or limited under applicable law, including mandatory consumer protection rights.

15. Miscellaneous

This Agreement is the entire agreement between you and Licensor regarding the Software and supersedes all prior or contemporaneous agreements, understandings, and communications regarding the Software.

If any provision of this Agreement is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect, and the invalid, illegal, or unenforceable provision will be enforced to the maximum extent permitted by law.

Licensor's failure to enforce any provision of this Agreement is not a waiver of that provision or any other provision.

You may not assign or transfer this Agreement or any rights under it without Licensor's prior written permission. Licensor may assign this Agreement as part of a merger, acquisition, reorganization, sale of assets, or other transfer of the Software or Licensor's business.
